Regulating the status of persons not registered in the Register of Births

The statelessness, the lack of registered civil status and non-possession of personal documentation is a serious problem when it comes to enjoyment of the basic social and economic rights for many persons living in Macedonia.

 

Poverty, marginalization and discrimination are a “standard” part of life for most of them. Stateless children are mostly concerned, bearing in mind that the basic rights are a luxury possessed by most of the children, but not by them.

The Public Call of the Ministry of Labor and Social Policy and the Office for Management of Registers of Births, Marriages and Deaths, was closed on the 1st of November 2018. The Public Call resulted with identification of 700 persons who did not posses any personal documents.

In February 2020, the Assembly has adopted the Law on Persons Not Registered in the Register of Births, which anticipates that these persons shall file request for inscription within 6 (six) months from the day the Law has been reached, i.e. until August 2020.

 

IMPORTANT

 

As per the Directive of the Government from 29th of May 2020, the deadline for filing the request for inscription in the separate birth register shall not be counted during the State of Emergency, and shall be continued for six months after the cessation of the State of Emergency.

  • In order for the Law to be functional, the authorized ministries shall reach the following bylaws:
  • MINISTRY OF JUSTICE
    • To define the content and manner of keeping a register for persons not registered in the register of births (Published in the Official Gazette of RNM no. 134 from 22nd May 2020)
    • Rulebook on the form and content of the request for inscription in the separate record of births, the form, content and manner of keeping the separate register of births, form and content of the excerpt from the separate register of births, form and content of the excerpt from the separate register of deaths and manner of issuing an excerpt from the separate register of deaths (Published in the Official Gazette of RNM no. 134 from 22nd May 2020)
    • REQUEST for additional inscription in the separate register of births MK document 1 and 2
